MINUTES OF THE PLANNING COMMITTEE MEETING 19 APRIL 2016

Present: Councillor Mrs L Noble (in the Chair), Councillors A Varley and Mrs J Butcher (ex-officio)

Apologies for absence were received from Councillors Mrs E Thompson, Mrs S Johnson and Mrs C Greenwell

1. PLANNING APPLICATIONS

A list of planning applications received since the previous Committee meeting had been circulated

1.1 16/00968/VARYCO: 9 Bell Villas, Ponteland, Newcastle upon Tyne NE20 9BD – Variation of Condition 7 (opening/delivery hours) of appeal reference APP/P2935/A/12/2169537/NWF (refused application 11/02297/FUL)

OBJECTION:
• Commercial competition is not a material consideration.
• No other similar eating establishment in Ponteland is open after midnight
• There is no designated car park and patrons either park indiscriminately around the area or are dropped off and collected by taxi; causing considerable disturbance not only in the near vicinity of the site but also in the surrounding residential neighbourhood.
• The Appeal Inspector stated that the application for development should be considered in respect of four issues, one of which was whether the scheme would seriously impair the residential amenities of nearby residents. The outside seating area was removed from the application to partly address this issue but the applicant reneged on this condition and only gained retrospective permission after it was constructed, contrary to the Inspector’s intentions. Consequently, the amenity of nearby residents has been impaired already and complaints have been made.
• The extension of opening hours into the early hours of the morning is inappropriate and would create unacceptable disturbance around the area, particularly for nearby residents.

1.2 Premises Licence Application: Yolo, 9 Bell Villas, Ponteland, NE20 9BD – Variation premises licence – on Friday and Saturday nights extend licensable activities to 01.00 hours and opening hours to 01.30 hours.

1.3 16/01192/VARYCO: Land West of Meadow Court House, Runnymede Road, Darras Hall, Ponteland NE20 9TA – Variation of condition 2 (approved plans) pursuant to planning permission 15/01474/FUL in order to allow changes for the inclusion of a new private access to Plot 1.

COMMENT: The provision of a separate entrance to the plot is cosmetic and unnecessary. The rural appearance of this area would be undermined and the established wildlife corridor impaired.

The Committee made no comments about the other 7 applications considered.

16/00931/FELTPO: Land South West of Bridge, Darras Road, Darras Hall Ponteland – Works to trees protected by a Tree Preservation Order: Tree 1(Holly) to be reduced in height, tree 2(Alder) to be removed, tree 3(Sycamore) to be removed.

An email had been received from Councillor Robin Ramsay providing additional information.

Part of the Committee’s comment had been that the reports and supporting documents supplied were from 2010 so more up-to-date information would be appropriate. Subsequently, an email had been received from Malcolm Thompson (Case Officer) advising that following the response to the consultation with NCC’s Ecologist an update to the site report had been requested.

2. DECISIONS: APPLICATIONS AND APPEALS; WITHDRAWN APPLICATIONS

2.1 DECISION 16/00434/FUL: 9 Callerton Court, Darras Hall, Ponteland NE20 9EN – Erection of an extension to rear of dwelling part two storey and part single storey.
Permission granted under delegated powers on 11 April 2016.
The Committee had made no comment about this application.

2.2 DECISION 16/00714/VARYCO: 3 West Thorn Farm, West Thorn, Kirkley NE20 0AG – Variation of condition 2 (approved plans) in relation to planning appeal APP/P2935/D/15/3132210 (planning ref. 15/01304/FUL) (Proposed addition of dormer windows to enable first floor accommodation).
Permission granted under delegated powers on 12 April 2016.
The Committee had made no comment about this application.

2.3 DECISION 16/00574/FUL: 2 Rothley Close Ponteland NE20 9TD – Garage extension to side/rear
Permission granted under delegated powers on 14 April 2016.
The Committee had made no comment about this application.

2.4 APPEAL DECISION APP/P2935/W/15/3136778 – NCC Ref 15/02272/FUL: Medwyn/Westmacot, Street Houses, Ponteland NE20 9BT – Change of use from dwelling to bed and breakfast and construction of two storey reception / bedroom area extension.

Appeal dismissed on 4 April 2016 (planning permission refused on 21 August 2015)
The Committee had made a comment about this application.

3. ANY OTHER BUSINESS

3.1 Branches Restaurant, Brewery Lane, Ponteland

Information had been received that NCC are in the process of taking formal enforcement action for the seating area/planters. An enforcement notice will be served requesting the removal of the structure; however this is not a quick process.
